WAIVER OF LIABILITY AND RELEASE
(Hockey Activities during the COVID-19 Pandemic)

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. Locally, the Governor of Iowa has declared a continuing State of Public Health Disaster Emergency. COVID-19 is reported to be highly contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and/or through droplets in the air. Persons reportedly can be infected with the virus and show no symptoms and therefore spread the disease. Presently, there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death.

Top Shelf cannot prevent you [or your child(ren)] from becoming exposed to, contracting, or spreading COVID-19 while participating these Top Shelf hockey activities. While Top Shelf is following all federal, state, and local guidelines, including the Rules and Procedures promulgated by the Ames/ISU Ice Arena, it is not possible to prevent against the presence of the disease. Therefore, if you [or your child(ren)] choose to participate in these Top Shelf hockey activities, you may be exposing yourself [or your child(ren)] to and/or increasing your risk of contracting or spreading COVID-19.

Accordingly, in consideration for being permitted to participate in these Top Shelf hockey activities, and in consideration of Top Shelf making available to the undersigned for his/her use while participating in these activities, certain equipment, facilities, grounds, or personnel, each of the undersigned, for him or herself, personal representatives, heirs, and next of kin:

ASSUMPTION OF RISK: Acknowledges having read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to participate in these Top Shelf hockey activities. Participation in these Top Shelf hockey activities are of such value to me [and/or my children] that I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of being exposed to, contracting, and/or spreading COVID-19.

WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against Top Shelf Hockey Midwest, LLC and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to participating in these Top Shelf hockey activities. I understand that this wavier means I give up my right to bring any claims including for personal injuries, death, disease, property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.

I understand and agree that this Wavier of Liability and Release is intended to be as broad and inclusive as is permitted by the laws of the State of Iowa.

I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS WAIVER OF LIABILITY AND RELEASE, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE:

PARENTAL CONSENT
The undersigned, as parent/guardian of the Participant, acknowledges I have read this Waiver of Liability and Release, fully understand its terms, understand that I have given up substantial rights belonging to me and my child/ward by signing it, and have signed it freely and voluntarily, without any inducement, assurance, or guarantee being made to me. I intend my signature to be a complete and unconditional release of all liability as a result of physical or bodily injury, damage, or death to the Participant, to the greatest extent allowed by law.
I hereby grant permission for my child/ward to participate in these Top Shelf hockey activities.
